Trademark registration in Iran is a crucial step for businesses seeking to protect their brand identity and intellectual property within the country. The process is overseen by the Iranian Intellectual Property Center, and it involves several essential steps. First, we conduct a thorough trademark search to ensure the proposed mark is not already registered or being used by another entity.

 

Once the search is complete, the application is submitted, which includes detailed information about the mark and its intended use. The Iranian trademark authorities will then examine the application for compliance with legal requirements and issue an examination report. If there are no objections, the mark will be published in the Official Gazette for public notice.

 

Following a designated waiting period, assuming there are no oppositions, the trademark will be officially registered. Trademark registration in Iran grants exclusive rights to the mark's owner for a period of ten years, renewable indefinitely. It's a crucial legal process for protecting brands and intellectual property rights in the Iranian market.

PROTECTION AGAINST UNFAIR COMPETITION

 

The Iranian Courts strictly prohibit brand infringements, and they encourage foreign companies, specially American brands, to use the law to protect their rights.

 

The Iranian government has adhered to a number of other international conventions and a committee composed of intellectual property law experts such as the International Bureau of the World Intellectual Property Organization (WIPO)

 

Under Iranian Government Law, copyright is protected under The Law for Protection of Authors, Composers and Artists Rights (1970) and the Law of Translation and Reproduction of Books, Periodicals and Audio Works (1973). 

The registration process in Iran must be done in Farsi language. The overall process may take up to 12 months from the date of registration. 

 

Requirements:

 

Trademark/Service Mark Applications
 

1- The full name and address of the applicant.

2- List of goods and/or services and related classes.

 

3- A sample of the mark. The mark must be in high resolution and in color. For three-dimensional marks the applicant must provide sufficient dimensions of the mark to be clearly represented.
 

4- Power of Attorney to the name of Ms. Shirin Salamat duly notarized and legalized by the Consulate of Iran in your home country.
 

5- Certified copy of priority document, if priority is to be claimed. 

In order to perform any of the following task, the required documents along with a notarized Power of Attorney  is required.

 

Renewal of Trademark

 

1- Power of attorney duly legalized up to the Consulate of Iran in your home country.

 

2- Photocopy of the previous certificate or registration in IRAN.

 

Assignment

 

1- Power of Attorney signed, by the assignee and legalized from the Consulate of Iran in your home country.

 

2- Deed of Assignment signed by both parties and legalized up to the Consulate of Iran in your home country.

 

3- The Original Iranian Certificate of Trademark registration or renewal for endorsement.

 

Change of Name and/or Address

 

1- Power of attorney in the new name and/or address, duly legalized up to the Consulate of Iran.

 

2- Certified and legalized copy of change of name and/or address document, duly legalized up to the Consulate of Iran.

 

3- The Original Iranian registration or renewal certificate for recordation of change of address.
